IMPORTANT – READ THIS AGREEMENT CAREFULLY

THIS AGREEMENT APPLIES ONLY TO MARYLAND PPT PRO.

This legal agreement explains when and how you may use copies of software products from Bright Shore Technologies, Inc.In this agreement:

·           "Software" means Maryland PPT Pro, and all related samples, documentation and other materials;

·           "Trial Copy" means a copy of the Software distributed by us or by our authorized agents for evaluation purposes and which is described as a trial, shareware, or unregistered copy in the Software's About screen or anywhere else in the Software.

·           "Licensed Copy" means a copy of the Software purchased from us or from an authorized dealer, and which is not described as a trial, shareware, or unregistered copy in the Software's About screen or anywhere else in the Software.

·           "we" or "us" means Bright Shore Technologies, Inc;

·           "you" means the end user of the Software.;

This is a legal agreement which allows you, the end user, to use the Software under certain terms and conditions. If you cannot agree to abide by what this agreement says you should not use the Software.

The Software is licensed, not sold.

Copyright Protection and Title : The Software is fully protected by copyright under U.S. law and international treaty provisions. You acknowledge that no title to the intellectual property in the Software is transferred to you. You further acknowledge that title and full ownership rights to the Software will remain the exclusive property of Bright Shore Technologies, Inc and you will not acquire any rights to the Software except as expressly set forth in this license.

License Rights : The rights of the license depend on the type of license. If you have not purchased a license from us, then you are subject to the terms of the Trial license. If you have purchased a valid license from us, then you are subject to the terms of the appropriate license.

·          Trial license . You are granted the right to use the Software for the period of time described in the documentation (printed and/or electronic) accompanying the Software, typically 14 days. After that you must either

·           Uninstall all copies of the Software from all of your computers on which it is installed or copied, or

·           Contact Bright Shore Technologies, Inc at www.mdppt.com to purchase the Software.

·          Single-User license . You may install the Software to one computer.In addition, you may install the Software on one laptop and one desktop computer, provided both are used by the same individual. The single-user license will not allow you to use any network features that are in the Software.

·          Network license . You may install the Software to an unlimited number of computers at a single physical address whose users are employed by the same company.

·           A single or network license includes the current tax year of use, updates, and support. A single or network license is good for the tax year which is clearly indicated in the Software. Subsequent years must be renewed annually, due to the regular and ongoing changes to the forms, data, and information contained in the Software. When you purchase the Software, you will receive a unique license file. You may not publish or distribute this file by any means. If you do, your license to use the Software is automatically terminated, and you must remove the Software from your computer(s).

Trial Copy Distribution : You may freely distribute copies of the original trial version of the Software, in its original format, so long as you do not charge more than a nominal fee to cover the cost of materials. You may not in any way change the original distribution file, except to package it within another archive if necessary.

Support : We cannot promise that the Software will be free of bugs or program errors, but if you report a program error or bug to us, we will do our best to correct it. Updates will be provided regularly through the Internet Update feature.

Limitation of Liability : Bright Shore Technologies, Inc does not warrant the Software to meet your requirements or that the software is free of defects. In no event shall we be liable for any incidental, consequential, or punitive damages whatsoever arising out of use of the Software, or your relationship with us. Note that some states do not allow exclusion or limitation of liability for incidental or consequential damages, therefore the above limitation may not apply.

Restrictions : You may not reverse engineer, de-compile, or disassemble the Software. You may not rent, lease, or lend the Software.

Termination : We may terminate this agreement if you fail to comply with the terms and conditions of this agreement. In such event, you must uninstall the Software from all your computers and destroy all copies of the Software.

Transfers : You may not distribute, nor in any way make available, our products license keys, license files, or serial numbers to any third party without written permission from us. You may permanently transfer all of your rights under this License Agreement, provided the recipient agrees to the terms of this License Agreement.

Critical Operations : The Software is not designed for, or intended to be used, in control equipment requiring fail-safe performance in which the failure of the Software could lead directly to death, personal injury, financial loss, or physical or environmental damage.

Jurisdiction : If you acquired the Software in the United States, this License Agreement is governed by the laws of the state of Maryland. If you acquired the Software outside of the United States, then local laws may apply.

Disclaimer for Trial Copies : you are not paying for the trial use license of the Software. Accordingly the

Trial Copy is provided "as-is" and without warranty of any kind.

Disclaimer for Licensed Copies : except as stated above, we disclaim any and all warranties, express or implied, oral or written, including any implied warranties of merchantability or fitness for a particular purpose.

You acknowledge that you have read and understand this agreement and agree to be bound by its terms. You further agree that this agreement is the complete and exclusive statement of the agreement between you and Bright Shore Technologies, Inc, and supersedes any proposal or prior agreement, oral or written, and any other communications relating to the subject matter of this agreement.

Your installation and use of the Software indicates your acceptance of this agreement.
